It can be what he says or how someone responds. Doesn’t matter which. But as he is the only ACTIVE doer here – the racist yapping – and it’s UNPREDICTABLE what he’ll say/do next because he’s the one ACTING – nobody else is. What guarantee does the officer have that he’s ONLY going to keep doing what he’s doing? What guarantee does the officer have the nobody is going to RESPOND in a way that results in clear-and-present-danger? Until he stops talking, it’s all up in the air.
